IPC 468 vs BNS 336(3)

Forgery for purpose of cheating

● Modified in BNS

Forgery intended for use in cheating carries up to 7 years' imprisonment and fine under BNS Section 336(3), unchanged from IPC 468, now expressly extended to forged electronic records as well as documents.

Indian Penal Code, 1860 · § 468

Section 468 IPC punished forgery committed with intent that the forged document be used for the purpose of cheating, with imprisonment of either description up to 7 years, and fine -- the more serious forgery variant compared with base forgery under Section 465.

Bharatiya Nyaya Sanhita, 2023 · § 336(3)

BNS Section 336(3) reproduces the offence and punishment unchanged, adding only the electronic-record extension: "intending that the document or electronic record forged shall be used for the purpose of cheating."

What changed?

Unchanged in substance apart from the electronic-record extension and the structural merge into BNS 336 as a numbered sub-section instead of a standalone section.
