Simple cheating -- not rising to the aggravated forms of inducing delivery of property or causing wrongful loss to a protected interest -- now carries up to 3 years' imprisonment under BNS Section 318(2), triple IPC 417's 1-year ceiling.
Section 417 IPC punished the base cheating offence, applicable whenever the conduct did not rise to the aggravated forms punished separately (wrongful loss to a person the offender was bound to protect, or dishonestly inducing delivery of property), with imprisonment of either description up to 1 year, or fine, or both.
BNS Section 318 restructures the cheating cluster into one section: sub-section (1) is the definition (same as old IPC 415), sub-section (2) is the direct successor to IPC 417 but with the maximum imprisonment tripled to 3 years, sub-section (3) corresponds to old IPC 418 (also increased, 3 to 5 years), and sub-section (4) corresponds to old IPC 420 (cheating and dishonestly inducing delivery of property, unchanged at 7 years and fine).
The conduct/definition of simple cheating is unchanged, but the maximum punishment triples, from 1 year under IPC 417 to 3 years under BNS 318(2) -- narrowing the punishment gap between simple cheating and its more aggravated forms.

Common defences include absence of dishonest intention at the time of the representation, a genuine commercial dispute or later inability to perform rather than an intent to deceive from the outset, and absence of actual deception.
